In a lawsuit recorded the other day in U.S. District legal in West Palm seashore, Island Company said Cotton On USA Inc. of La Mirada, Calif., fooled its trademarked phrase.
Island Company emblazons $40 T-shirts and $32 tank tops using the expression: “Quit Your Task, Purchase A Ticket, Get A Tan, Fall-in Prefer, Never Ever Get Back.” Based on the fit, Cotton On sells $9 t-shirts that read: “Quit You’r (sic) Job, Buy a Ticket, Travel the World, Fall in prefer, Repeat.”
Island Company labeled as Cotton On’s grammatically challenged motto “confusingly similar” to its catchphrase. Island Company requested a federal judge to order Cotton to destroy the offending garments.
“The defendant’s deliberate conduct is likely to lead to consumers purchasing the defendant’s product in mistaken belief it arises from Island Company, ” the suit said.
Cotton On has actually six shops in South Florida, including one during the Mall at Wellington Green. The organization has not taken care of immediately Island Company’s fit.
